To get this resolved quickly, please submit your request through your homeowner portal or your association's Community Manager and include: your community name, property address, the violation/fine reference number, and the date of the original notice. Ask for the written basis for the fine and the status of any owner response/appeal or hearing request so the Board can review and provide a determination.

In a condominium, responsibility is defined by the Condominium Declaration and By-Laws - not simply by whether plumbing lines are connected or how severe the backup appears. In general:

** The Association is responsible for common elements (and, where applicable, limited common elements) as defined in the governing documents.
** The Unit Owner is responsible for items serving only their unit, including many interior components and conditions that originate within the unit’s boundaries or are determined to be unit-specific.

When a plumbing issue is reported, the Association’s vendor is dispatched to diagnose the source. If the vendor determines the condition is isolated to one unit, the cost is typically charge-backed to that unit owner consistent with the Association’s policies. If the vendor determines the issue is within a common element or limited common element the Association is obligated to maintain, the expense is paid by the Association.

In this matter, the vendor’s assessment indicated the issue was unit-specific rather than a common-element failure, and you were advised in writing that the invoice would be processed as a charge-back consistent with that determination and the Association’s standards. Genesis does not independently decide what the Association “should” pay; the Board establishes the policies, and we administer them based on the governing documents and vendor documentation.

If you believe the diagnosis was incorrect, the appropriate next step is to request a formal review so the vendor notes and invoice support can be provided, and the matter can be submitted to the Board for consideration.

Ali, we take all feedback seriously, but your review appears to be driven more by emotion than by an objective account of events. The lawsuit you referenced is disclosed on the resale certificate, which is the proper and legal method for conveying that information during the sale of a property.

Additionally, any changes made to the structure of a unit, if applicable, require prior approval from the association’s Architectural Control Committee. Genesis follows the direction of the Board and relevant committees in all such matters and does not make independent decisions.
