Como usted bien sabe, es el propietario quien devuelve la fianza, no la inmobiliaria, tras comprobar si el inquilino ha dejado el piso en el estado que lo recibió. Y, en su caso, no se la retornó porque usted dejó el piso en mal estado.

Negative experience: I have never felt so betrayed as I have by this real estate agency. With this service, I have learned that you should never trust anyone, no matter how good they seem. During my stay in an old apartment, at the beginning of the lease, we informed them of several damages that the apartment had to keep them in the loop, and they downplayed it by claiming that the apartment was old. We, as students, trusting their friendliness, decided to either fix these damages ourselves or live with them. What happened when we left the apartment? They disregarded their word and started demanding payment for all those things, and even sold us a cleaning bill for 420 euros for cleaning an apartment that we had already washed. During our stay in the apartment, we spent 3 months losing water with all the annoyance and noise that comes with it, and they also did not provide a solution, saying that 'it was okay, the owner would pay for it.' Furthermore, they tried to turn us against each other by inventing that one of us had given them the right to deduct money from the deposit if necessary (which I find to be very shameless). Advice for people who contact their services: do not speak to them on the phone, keep everything in writing because they break their word every time they can, record everything upon arriving at the apartment, complain about every little damage, no matter how minuscule it is, so that they cannot later claim against you. If you need to communicate anything to them, put it in writing because everything said over the phone is worthless. Above all, pay attention to the contract; there are abusive clauses everywhere, read it carefully before signing.
Sr. Rojas: como usted sabe, la fianza legalmente se constituye para responder del buen estado del piso frente al propietario, como consta escrito en el contrato que firmaron. Esa es la función de la fianza, ni es ninguna cláusula abusiva, ni nunca le dije que usted haya dado derecho a quitar nada. Es lo que dispone para todo el mundo el Artículo 36 de la Ley de Arrendamientos Urbanos.Quisiera aclararle que el importe de la fianza quedó en depósito de la propietaria, no de la inmobiliaria. Y recordarle que cuando firmaron el contrato ustedes le entregaron la fianza directamente a la arrendadora (y así consta reflejado en el contrato).En la inmobiliaria no guardamos ninguna fianza nunca, ni por tanto la podemos devolver tampoco nosotros.Por lo que me ha comentado la arrendadora, les ha retenido parte de la fianza por gastos del mal estado en que dice que dejaron el piso. Usted podrá estar de acuerdo con ese importe o no, pero es la arrendadora quien les reclama a ustedes que le abonen esos gastos y se los descuenta de la fianza. NO la inmobiliaria.Por parte de esta inmobiliaria hemos actuado profesionalmente y cualquier incidencia que tuvieron mientras fueron inquilinos con averías u obras, se la hemos resuelto en el acto. Y el problema de la fuga de agua se les reparó enseguida, en el momento en que ustedes nos lo dijeron.Además esas fotografías que dice usted de cómo estaba el piso ya existen: anexo al contrato de arrendamiento se hizo un inventario fotográfico del estado del piso cuando se arrendó, del cual usted tiene una copia tanto del contrato como de las fotos.

Sr. Garriga: para aclararle que la fianza quedó en depósito de la propiedad, no de la inmobiliaria, que no guardamos ninguna fianza nunca ni por tanto la devolvemos tampoco nosotros.Como usted bien sabe, la fianza para responder del buen estado del piso se la entregó usted mismo directamente a la propietaria, el día que se firmó el contrato, y además consta escrito expresamente en el contrato.Por lo que me ha comentado la arrendadora, le ha retenido parte de la fianza por el mal estado que dejaron el piso.Por parte de esta inmobiliaria hemos actuado profesionalmente y cualquier incidencia que tuvo mientras fue inquilino con averías u obras, se la hemos resuelto en el acto.Y, como estudiante universitario que es usted, le informo que el uso de palabras como “estafador” puede constituir legalmente un delito de calumnias.

Y tomarse esas confianzas con mi nombre cuando no me conoce de nada, como si estuviéramos en el patio del colegio, me parece muy infantil de su parte.Si usted quiere hacerse el gracioso y decir esas fantasmadas como que alquila los pisos de 10 en 10, le deseo suerte en otro lugar pero no espere que nadie le tome en serio.

Fantastic experience: Magnífico profesional. Hace 3 años le compramos un piso que después también nos alquiló, quedamos tan contentos con la gestión que desde entonces se ha convertido en nuestro gestor immobiliario de confianza. Selecciona bién los inquilinos y también se preocupa de su bienestar y de que todo funcione correctamente, la verdad lo hace fácil y cómodo para ambas partes. El año pasado vendimos otro piso a través de él de manera rápida y efectiva. Lo he recomendado a varios amigos que también han quedado muy contentos. Tanto él como su señora, que es quien se ocupa de los contratos son muy profesionales y de total confianza. En cuanto a los honorarios, son muy razonables, claramente por debajo de otras immobiliarias.

Fantastic experience: A través de esta inmobiliaria vendí un piso hace poco y se ajusta en el precio, me pidió una comisión bastante menor que las que me solicitaban otras agencias, y además se esperó a a cobrar sus honorarios hasta la firma de la escritura ante el Notario, que otras agencias me la pretendían cobrar ya antes cuando se firmasen las arras. He quedado muy contento con ellos.
