During these inquiries, it was detected that the property had not been correctly registered, requiring a grouping of properties or an extinction of horizontal property to ensure that the buyer could obtain financing. Additionally, we carried out negotiations with your bank, including proposing a subrogation to the buyer, to facilitate the operation. However, despite these alternatives, we understand your decision not to take the necessary actions to resolve these irregularities. Finally, when the buyer conducted the appraisal, the resulting conditions led them to withdraw from the purchase of the house. We also maintained communication with your lawyer, who understood the steps taken and the conditions of the process. As a demonstration of our commitment, we have taken on the expenses arising from the management carried out. As we have mentioned internally, at Mocadi we have always tried to harmonize the wills of the buyer and the seller to reach an agreement on terms of price and payment conditions of the property. In every negotiation, various issues participate, such as dates, prices, and specific conditions, which do not solely depend on the mediating agent but on the willingness of both parties. Regarding your situation, we would like to clarify some important aspects: The list of furniture initially approved on August 12, 2023, was affected by subsequent extensions that you introduced, which influenced the duration of the negotiations and caused delays in dates. From August 23, as you mentioned, discrepancies arose on your part regarding the earnest money contract, leading to the involvement of your lawyer. With whom the agent Mr. Roselló negotiated cordially and concluded by specifying the terms of the issues raised, even thanking our agent for his understanding and service. Regarding the impossibility of modifying the earnest money contract, we want to reiterate that this limitation is linked to the necessary approval of the mortgage loan, the timelines of which are largely defined by the banking institutions. Regarding your concerns about the discrepancies in the signing dates and the conditions for moving into the apartment, it is important to note that these discrepancies do not fall on the mediating agent but arise from joint decisions in the purchase and sale process between the parties. Despite these challenges, as compensation for the delay in signing due to the processing of the right of first refusal and retraction, we committed to covering the notary fees corresponding to the buyers.
