Negative experience: After contacting this group through an Idealista ad about an apartment I was interested in renting, the sales agent, named Rafael, tells me that I must pay three months' rent, one of them for 'agency fees'. 'Agency fees' that according to the law, it is illegal to charge me, because these are expenses that are the landlord's responsibility (LAU, article 20.1, 'The costs of real estate management and the formalization of the contract are to be borne by the landlord', first capture). I promptly try to clarify this point, to which the agent initially claims to know nothing about until I mention the article, when he completely changes his tone and tells me that 'perhaps this is not the apartment for me, nor the real estate agency'. It is very clear that even after this law was changed last year to prevent these types of illegal charges, some real estate agencies prefer to take more money out of our pockets. Disgraceful. P.S.: In response to the answer given a moment ago by the agency itself, that an advisor has been with the company for a short time is not a reason for them to completely change their demeanor towards a client interested in a conversation. In the phone call prior to the displayed WhatsApp conversation, the advisor also does not justify this expense for the non-payment insurance you mentioned (which does not excuse or serve as a reference for those agency fees he told me about): not knowing or not stating, even though he has been with the agency for a short time, shows not only a lack of professionalism, but complete ignorance about the rental conditions of an apartment, something that should be assumed they must know. Following this line, that subscription and payment for the non-payment insurance service is an expense that should also be borne by the property owner and not by the person interested in renting it. No matter how much the LAU indicates that the parties can agree to any type of guarantee or deposit to ensure compliance with lease obligations, this is something that should also be shown or at least mentioned by the agent in question or in the ad description: a non-payment insurance protects, covers, and guarantees the interests of the landlord, so logically, they should cover it; if they do not want to, it should be the agency or the ad itself that states it, as I have said. The same happens with this feasibility study and with the guarantee; these are conditions that neither the advisor indicated to me (since he told me that 'the costs of these apartments are usually their monthly payment multiplied by three, one for the rent, another for the deposit, and the other for agency fees'): these are more conditions and more expenses that are neither described in the ad nor mentioned by the sales agent. The owner can request anything, and it is completely understandable, but the least a person asks for is to be told what they are requesting so they can decide whether or not they are interested in proceeding: and it has become clear that if the ad did not mention it, the agent was also not willing to do so.
